Masvidale’s attorney, Bradford Cohen, included “compound photographs” of alleged injuries to “CC” – his knowledge of Covington – as documents in an application for the fighter’s medical records. Covington claimed she sustained a brain injury in the alleged assault that took place outside a Miami Beach steakhouse on March 21.
In the photo, Covington’s front teeth appear to be poorly chipped, reflecting the injury he reported to responding police. The former UFC interim welterweight has protected his identity with a Florida privacy law designed to protect crime victims, but Masvidal appointed him last month in court.
The exhibition included other photos that showed Covington’s face damage after the alleged assault, which the attorney said contradicted the alleged victim’s claims.
“Interestingly, the images do not show an infection except for a small chip in the false CC tooth,” Cohen wrote in his request for medical records. “The evidence collected so far clearly contradicts CC’s allegations. CC claims that the defendant hit him from behind. Exclusive footage shows that during the incident, CC was facing the person he identified as the defendant. In fact, the CC was looking at the defendant in the face. face before receiving the blow and then appear to flee the defendant in fear.”
The video clip referred to by Masvidal’s lawyer was not immediately available.
In addition, Cohen included images said to represent a $95,000 Rolex Covington watch that was allegedly damaged in the attack. He referred to the watch as a “Folex” – or “Frankenstein Rolex” – because he believed it was not authentic, and noted that felony charges arising from alleged damages of more than $1,000 did not apply.
“This moniker indicates that the watch is made up of aftermarket parts including fakes or imitations Rolex Parts and maybe real Rolex Components – Certainly negates the certification that the watch is worth $95,000.00,” he wrote. “To calculate repair costs and the extent of damage to CC’s FOLEX, the watch must be closely examined to determine the true value of the watch.”
Cohen has also included photos of Covington’s recent social media posts and a photo of UFC 272 Masvidal Punching Covington Show.
The latter two were directed refutations of Covington’s claim of a brain injury. Cohen wrote that if one does occur, an independent medical examination should be conducted before recovery. At the same time, the lawyer wondered if this could be the case in light of Covington’s career and his recent meeting with Masvidal in the appraiser.
“Given the State Department and CC’s allegations – coupled with the fact that CC is a professional combatant at risk of repeated bodily injury – Defendant requests access to CC’s prior medical records to properly defend himself against the charges in this order,” Cohen wrote. “Specifically, to ensure that a single blow to a CC’s jaw caused brain damage when a CC’s career as a fighter exposed him to such an injury periodically.”
If a brain injury did indeed occur, Cohen felt that Covington should also be mentally examined to determine if he was able to proceed with the case.
“Given that not only is the alleged injury mysterious, but the victim here is a professional fighter, the site below suggests that a mental examination may be necessary due to the vagueness of the allegations,” Cohen wrote. “A mental examination may also be ordered to determine if CC qualifies to proceed with this matter or if he becomes ineligible due to the nature of his ‘brain injury’.
Masvidal was ordered to remain at least 25 feet from Covington at all times during a recent hearing on the case. Masvidal has pleaded not guilty to two counts, aggravated battery and criminal corruption. Covington has not commented publicly on the case.
In the octagon at UFC 272, Covington won with a dominant decision over Masvidal, his former roommate and training partner, to remain in the welterweight title picture. The escalation of the fighting was marked by personal bad chatter and insults directed at the Masvidal family. According to the alleged assault incident report, Masvidal told Covington during the incident, “You shouldn’t have been talking about my children.”
